1. Acceptance

These Terms & Conditions ("Terms") form a legally binding agreement between you ("the User", "you", "your") and Trivartha ("Trivartha", "we", "us", "our"), the provider of the BharatGeoTag mobile, desktop and web application (the "Service"). By installing, registering for, or otherwise using the Service, you confirm that you have read, understood and agreed to these Terms and to our Privacy Policy, which is incorporated by reference.

If you do not agree, do not install or use the Service.

2. Definitions

• "App" — the BharatGeoTag software distributed under the package identifier com.trivartha.bharatgeotag (or any successor identifier).
• "Free Tier" — the default feature set available without a paid subscription.
• "Pro" or "BharatGeoTag Pro" — the optional subscription tier offering additional features as described in §5.
• "User Content" — photographs, videos, stamps, projects, visits, inspections, custom fields, stamp templates and any other material you create or import into the Service.
• "Outputs" — derived artefacts produced by the Service from your User Content, including stamped JPEGs and PDF Field Reports.

3. Eligibility & Account

You must be at least 18 years old (or the age of digital consent in your jurisdiction) and legally competent to enter into a contract under the Indian Contract Act, 1872 to use the Service. Where the Service offers optional sign-in, you agree to provide accurate information and to keep your credentials confidential. You are responsible for all activity that occurs under your account.

4. License & Service Description

Subject to your compliance with these Terms, Trivartha grants you a limited, non-exclusive, non-transferable, revocable license to install and use one copy of the App on devices you own or control, solely for your personal or internal business field-documentation purposes.

4.1 Free Tier features

• Unlimited GPS-stamped photo capture and on-device storage.
• Time-bounded Field Visits, categorical Site Inspections, and Property Inspections (Before / During / After or category buckets).
• Color-tagged Projects, in-app Gallery, photo editor, QR scanner, company branding, built-in stamp templates A–D and one user-defined stamp template.
• Map snapshot using the Normal OpenStreetMap tile style on the stamp.
• PDF Field Reports.
• 10 successful exports per calendar month. Free-tier exports that succeed count toward this quota; failed attempts do not.

4.2 Pro features (subject to a valid subscription)

• Stamp template E Premium, plus unlimited user-defined stamp templates.
• Premium map types: Satellite, Terrain, Cycle, Hiking.
• Unlimited exports.
• Priority support.

5. Subscriptions & Billing

Billing. Payment is processed by Google Play (Android) or Apple App Store (iOS). Prices displayed in the app are inclusive of GST where applicable. By subscribing you authorise the storefront to charge your saved payment method until you cancel.

Cancellation & refunds. You can manage and cancel your subscription from your storefront account settings at any time. Refunds, where applicable, are governed by the storefront's refund policy. Statutory cooling-off rights under the Consumer Protection (E-Commerce) Rules, 2020 are honoured where they apply.

Free-trial conversion. If you start an Annual free trial, you have 3 days to cancel at no charge. After the trial, the annual fee is charged unless you cancel before the trial ends.

Price changes. We may change subscription prices at the end of the current billing cycle. You will be notified in advance; continued use after the change constitutes acceptance.

Taxes. You are responsible for any applicable taxes other than GST, which we collect as the supplier.

6. Acceptable Use

You agree not to use the Service to:

• Capture, store or share any image or data that infringes the privacy, publicity, intellectual-property or other rights of any person, or that is unlawful under Indian law.
• Stalk, surveil, harass or threaten any person.
• Capture content from any location where photography is restricted (defence installations, certain private premises) in violation of applicable law or signage.
• Reverse-engineer, decompile or attempt to extract the source code of the Service, except to the extent expressly permitted by applicable law.
• Use any automated means to access, scrape or interact with the Service, or to probe or test the security of our infrastructure without our written consent.
• Resell, sublicense or commercially exploit the Service or Pro entitlement except as expressly permitted by these Terms.
• Upload malicious code, or attempt to interfere with the Service or any related system.

You are solely responsible for the legality of the User Content you create and the contexts in which you use the Service.

7. Your Content & Intellectual Property

You retain all rights in your User Content. Because the Service stores User Content on-device, we have no server-side copy of your photos, projects, visits, inspections or properties.

You grant Trivartha a limited, worldwide, royalty-free licence to host, transmit, process and display your User Content solely to the extent necessary to operate the Service on your behalf (for example, to write a stamped JPEG to disk when you tap the shutter).

Our IP. The App, its source code, design, brand marks, the name "BharatGeoTag", the tagline "Capture. Locate. Prove.", the saffron-and-indigo theme, stamp templates A–E (excluding any user-defined templates you create) and all related documentation are the intellectual property of Trivartha or its licensors and are protected under the Copyright Act, 1957, the Trade Marks Act, 1999 and applicable international law.

Feedback. If you send us suggestions, we may use them without restriction or compensation to you.

8. Third-Party Services

The Service integrates with third parties such as OpenStreetMap, Open-Meteo, India Post, Google Play Billing and Apple StoreKit. Your use of those services is governed by their own terms. We are not responsible for the availability, accuracy or content of any third-party service.

9. Disclaimers

Without limiting the above:

• GPS accuracy. GPS fixes depend on hardware, satellite visibility, atmospheric conditions and local interference. The accuracy bucket shown on the stamp (Excellent / Good / Fair / Poor) is a best-effort estimate, not a certification. Do not rely on the stamp as the sole evidence in legal or financial disputes without independent verification.
• Address accuracy. Reverse-geocoded addresses are derived from third-party data sources and may be incomplete, outdated or incorrectly localised. Always verify before relying.
• Tamper evidence. The stamp is a deterrent, not a cryptographic proof. A determined attacker with image-editing tools can manipulate the overlay. For evidentiary-grade integrity, export the JPEG and use an external hash chain or trusted timestamping service.
• Offline behaviour. The map snapshot and weather tiles require Internet. Without Internet, those fields will read "unavailable" but the photo is still stamped with the rest of the captured data.

10. Limitation of Liability

To the maximum extent permitted by the Information Technology Act, 2000 and other applicable Indian law, in no event shall Trivartha, its partners, employees, agents or licensors be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data, goodwill or business opportunity, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages.

In jurisdictions that do not allow the exclusion of certain damages, Trivartha's aggregate liability for any claim arising under these Terms shall not exceed the greater of (a) the amount you paid Trivartha for the Service in the twelve (12) months preceding the claim, or (b) INR 1,000.

11. Indemnification

You agree to indemnify and hold Trivartha and its partners harmless from any claim, demand, loss or expense (including reasonable legal fees) arising from your breach of these Terms, your User Content, or your use of the Service in violation of any applicable law.

12. Termination

These Terms remain in effect until terminated. You may terminate at any time by uninstalling the App and, if applicable, cancelling your Pro subscription through your storefront. We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms.

Upon termination: (a) the license granted in §4 ends; (b) the on-device data remains on your device unless you use the in-app Erase my data action — see our Data Deletion guide; (c) clauses that by their nature should survive (Disclaimers, Limitation of Liability, Indemnification, Governing Law) will survive.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at the registered office of Trivartha.

Before filing any formal action, we encourage you to contact our Grievance Officer (see §15) and attempt to resolve the dispute informally within 30 days. Nothing in this clause limits your rights as a consumer under the Consumer Protection Act, 2019, or your right to approach the Data Protection Board of India under the DPDP Act, 2023.

14. Changes to These Terms

We may revise these Terms from time to time. Material changes will be announced through an in-app banner at next launch. The Effective date at the top of this page reflects the latest revision. Continued use of the Service after the effective date constitutes acceptance.
